Terms of Service

1. This agreement

These Terms are between you and FiduKit ("FiduKit", "we", "us"). By creating an account, purchasing, or using the software, you agree to them. If you are using FiduKit on behalf of a firm or an estate, you confirm you are authorised to accept these Terms for that entity.

2. What FiduKit is — and is not

FiduKit is self-help document-preparation software. It reads financial statements you supply, organises the transactions into schedules, performs arithmetic, and assembles Judicial Council GC-400 series forms and related attachments into a document you can review, sign, and file.

FiduKit is not, and does not hold itself out as:

  • a law firm, an attorney, or a provider of legal advice or legal services;
  • a legal document assistant, paralegal service, or registered document preparer acting on your behalf;
  • an accountant, auditor, bookkeeper, or provider of tax or financial advice;
  • a filing agent — we never submit anything to any court, and we have no relationship with any court.

Selecting the correct forms, deciding whether a transaction was a proper expenditure, interpreting a court order, and deciding what to file are legal judgments. They are yours, and we recommend you obtain them from a licensed attorney. Nothing produced by the software is reviewed by an attorney.

3. Your responsibilities

  • Accuracy of inputs. You supply the statements and the period. Output can only be as complete and correct as what you put in.
  • Review before filing. You must read the packet in full before signing or filing it. Signing a court document is your act, under your professional obligations and, where applicable, penalty of perjury.
  • Authority. You confirm you are entitled to possess and process the financial records you upload — as an appointed fiduciary, their agent, or an authorised representative.
  • Local rules. You are responsible for your court's local requirements, which vary by county and which the statewide forms do not cover.
  • Your credentials. Keep your sign-in email and your exported project files secure. Project files contain your accounting.

4. Where your data lives

Statements and the accounting derived from them are processed and stored on your own device. We do not receive, transmit, or store them. Consequently we cannot recover your work if you clear your browser storage, lose your device, or lose an exported project file, and we cannot produce your accounting in response to a third-party request, because we do not have it. Our servers hold only your account email, case metadata (a case label and a due date), and purchase records — see the Privacy Policy.

5. Payment

FiduKit costs $199 per accounting, charged once, at purchase — before you use the software on that accounting. Each additional accounting is a separate purchase at the same price. There is no subscription and no recurring charge. Payments are processed by our merchant of record, who is the seller of record for the transaction and handles applicable taxes; their terms apply to the payment itself.

The price shown at checkout is the price charged. Price changes are published on the pricing page at least 30 days before taking effect and never apply to a purchase already made.

A purchase entitles you to unlimited regeneration and re-export of that accounting, including corrected and amended versions. You are not charged twice for the same accounting.

6. Refunds

If a packet is not usable, email [email protected] and we will refund the purchase. We resolve refund requests in your favour by default.

That expressly includes the case the sales pages name: if FiduKit cannot read your statements well enough to build the accounting, tell us and we refund it. No explanation is required beyond telling us, and there is no form to complete — a plain email to support is the whole procedure. Nothing in these Terms conditions that refund on a time limit, on the state of the accounting, or on your reason for asking.

A refund issued as goodwill does not revoke access to a packet you have already downloaded — you keep the work. A payment reversed through a chargeback or payment dispute does revoke the entitlement associated with that purchase.

7. Acceptable use

You agree not to:

  • use the software to prepare filings you are not authorised to prepare;
  • resell, sublicense, or offer the software itself as a service to third parties;
  • attempt to circumvent the purchase requirement or the balancing requirement;
  • reverse engineer for the purpose of building a competing product, except to the extent that restriction is unenforceable where you live;
  • upload material you have no right to possess.

8. Intellectual property

The software, its interface, and its content are ours. You receive a personal, non-exclusive, non-transferable licence to use it to prepare accountings. Everything you produce with it — the packet, the schedules, the exports — is yours, and we claim no interest in it and no right to use it. Judicial Council forms are public forms of the State of California; we are not affiliated with, endorsed by, or acting for the Judicial Council or any court.

9. Disclaimer of warranties

The software is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any court, examiner, or judge will accept a packet, that parsing will succeed on every statement format, or that the software will be uninterrupted or error-free.

We take accuracy extremely seriously and test against real accountings that courts accepted. That is a commitment about how we work, not a legal warranty of outcome, and it does not replace your obligation to review what you sign.

10. Limitation of liability

To the maximum extent permitted by law, FiduKit will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost goodwill, court sanctions, surcharge, removal, or professional discipline arising out of your use of the software.

Our total aggregate liability for any claim is limited to the amount you paid us for the accounting giving rise to the claim.

Some jurisdictions do not allow certain exclusions; where that is so, the exclusions apply only to the extent permitted, and nothing here limits liability for fraud or for anything else that cannot lawfully be limited.

11. Indemnity

You agree to indemnify FiduKit against claims arising from your filings, your use of the software outside these Terms, or your breach of a duty you owe to a court or to a person whose estate you administer.

12. Termination

You may stop using FiduKit at any time and may delete your account from within the product. We may suspend an account for a breach of section 7. Termination does not affect packets you have already downloaded or project files on your own computer — they remain yours and remain usable.

13. Changes to these terms

We may update these Terms. Material changes are announced on this page with a revised effective date, and — for anyone with an account — by email. Continuing to use the software after a change takes effect means you accept it.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in California have exclusive jurisdiction. Nothing here waives any right you have under mandatory consumer-protection law where you live.
